1. Agreement
These Terms of Use (“Terms”) are a contract between you and Trading Practice (“we”, “us”). They govern your use of the Trading Practice mobile application and the website at tradingpractice.io (together, the “Service”).
By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2. What the Service is
Trading Practice is an educational trading simulator. It provides:
- a simulated trading environment with a virtual balance of $50,000;
- structured lessons on trading concepts;
- a journal of your simulated trading activity, with statistics.
The Service has no user accounts. You do not register and we do not ask for your email address. Your progress, journal and settings are stored on your device.
3. What the Service is not — please read this section
No real money. The Service does not accept deposits, does not process withdrawals, and does not handle funds of any kind. Every balance, position, order and result shown in the Service is simulated.
No brokerage. We are not a broker, dealer, exchange, investment adviser, or financial institution. We are not registered with or licensed by any financial regulator, and we do not need to be, because we provide no financial service. The Service is not connected to any brokerage account and cannot place a real order.
No advice. Nothing in the Service — including lessons, statistics, and any communication from us — is financial, investment, tax or legal advice, or a recommendation, solicitation or offer to buy or sell any financial instrument. You are solely responsible for any decision you make outside the Service.
No performance claims. Simulated results are not real results. Simulated performance does not indicate, predict or guarantee future performance of any kind. A simulator does not carry the financial and psychological pressure of real trading, and results achieved in it should not be expected to transfer to a real account.
Trading real financial instruments carries a risk of losing money, including more than you invest. If you decide to trade with real money, do so through a properly licensed provider and consider taking advice from a qualified professional.
4. Virtual balance
The virtual balance and any in-app points, levels or scores have no monetary value. They cannot be purchased, sold, transferred, withdrawn, redeemed or exchanged for money or anything of value, inside or outside the Service. You may reset your virtual balance at any time.
5. Market data
Price data shown in the simulator is generated by us for educational purposes. It does not represent live market quotes, is not sourced from any exchange or market data vendor, and must not be relied on as a source of market information or for any real trading or investment decision.
6. Your data and your device
You do not create an account, and there is nothing for us to hold on your behalf. Your lesson progress, simulated trades, journal and settings live on your device.
Two consequences follow, and you should be aware of both:
- We cannot recover your progress. There is no backup and no synchronisation between devices. If you delete the app, change device, or use Settings → Privacy → Reset all data, your progress is permanently gone.
- We cannot restore anything you erase. The reset control acts immediately and cannot be undone.
You must be at least 16 years old to use the Service.
7. Acceptable use
You agree not to:
- use the Service for anything unlawful, or in breach of any regulation that applies to you;
- present output from the Service as financial advice or as a real trading record to any third party;
- reverse engineer, decompile or attempt to extract the source code of the app, except where that restriction is prohibited by law;
- scrape, bulk-download or resell content from the Service;
- interfere with the Service or probe it for vulnerabilities;
- upload or create content that is unlawful, abusive, or infringes anyone’s rights.
We may block access for anyone who breaches this section.
8. Links to third parties
The Service contains links to partner brokers and to their listings in app stores. Those are separate services that we do not operate and do not control. We are not responsible for their content, their products, their terms or their treatment of your data, and a link is not a recommendation to open an account or to trade with real money. Anything you do on a third-party service is between you and them.
We receive nothing when you follow one of these links — no referral fee, no commission, and nothing if you go on to open an account. The Service is free, has no in-app purchases, and we have no commercial arrangement with any broker listed in it. A link is information, not a recommendation.
9. Intellectual property
The Service, including its software, lesson content, design, text and branding, belongs to us or our licensors and is protected by intellectual property law. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app on devices you own or control, for your own educational use, for as long as you comply with these Terms.
Content you create in the Service — such as journal notes — remains yours, and stays on your device.
10. Disclaimer of warranties
To the fullest extent permitted by law, the Service is provided “as is” and “as available”, without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that data shown in it will be accurate.
Nothing in these Terms excludes or limits any right you have that cannot be excluded or limited under the law that applies to you as a consumer.
11. Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or opportunity, arising from or connected to your use of the Service.
In particular, we are not liable for any trading or investment loss you incur outside the Service, whether or not you say it was influenced by lessons, statistics or anything else in the Service.
We are not liable for the loss of progress, journal entries or other content stored on your device, including loss caused by deleting the app, changing device, or using the reset control. See section 6.
Because the Service is free of charge, our total aggregate liability to you for all claims is limited to USD 100 or the minimum amount permitted by applicable law, whichever is greater.
12. Changes to the Service and to these Terms
We may add, change or remove features, and we may suspend or discontinue the Service.
We may update these Terms. We will update the “Last updated” date and, where the change is material, notify you in the app before it takes effect. If you do not accept the updated Terms, stop using the Service and delete the app.
13. Termination
You may stop using the Service at any time by deleting the app. We may block access if you breach these Terms, if required by law, or if we discontinue the Service. Sections 3, 4, 5, 9, 10, 11 and 15 survive termination.
14. Apple
You acknowledge that these Terms are between you and us, not Apple, and that Apple is not responsible for the Service or its content. Apple has no obligation to provide maintenance or support for the app. Apple is not responsible for addressing any claim you have relating to the app, including product liability claims, claims that the app fails to conform to any legal or regulatory requirement, and claims arising under consumer protection or similar legislation. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
15. General
If any provision of these Terms is held unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a merger, acquisition or sale of assets. These Terms and the Privacy Policy are the entire agreement between us regarding the Service.
